(AP) ? Months after receiving complaints about the New York Police Department's surveillance of entire American Muslim neighborhoods, the Justice Department is just beginning a review to decide whether to investigate civil rights violations.

Attorney General Eric Holder told Congress the status of the review Tuesday.

The announcement bothered some Democrats, who said they were under the impression the Justice Department had been reviewing the matter since last late last year.

Documents obtained by The Associated Press show that the NYPD has built databases pinpointing where Muslims live, where they buy groceries, what Internet cafes they use and where they watch sports. Dozens of mosques and student groups have been infiltrated, and police have built detailed profiles of Moroccans, Egyptians, Albanians and other local ethnic groups. The NYPD surveillance extended outside New York City to neighboring New Jersey and Long Island and colleges across the Northeast.

Holder told Congress that police seeking to monitor activities by citizens "should only do so when there is a basis to believe that something inappropriate is occurring or potentially could occur."

Holder responded under questioning by Rep. Mike Honda, D-Calif., who as an infant was sent with his parents to a Japanese internment camp during World War II and has compared that policy to the NYPD's treatment of Muslims. The attorney general was on Capitol Hill to discuss the Justice Department's federal budget.

Holder did not suggest that a Justice Department investigation of the NYPD was imminent. Over the last six months, the AP has revealed the inner workings of secret programs of the NYPD, built with help from the CIA, to monitor Muslims.

"I don't know even if the program as it has been described in the news media was an appropriate way to proceed, was consistent with the way in which the federal government would have done these things," said Holder, who was born in the Bronx and described New York Police Commissioner Ray Kelly as a personal friend. "I simply just don't know the answers to those questions at the beginning stages of this matter."

That surprised Rep. Rush Holt, D-N.J., one of the first lawmakers to ask the Justice Department to scrutinize the NYPD's operations.

"They very definitely gave me the sense that they were farther along in their investigation than just reviewing some mail," Holt said.

Honda said his goal Tuesday was to push the issue so that Holder pays more attention to what's going on in New York.

The AP has reported that some of the NYPD's activities ? such as its 2006 surveillance of Masjid Omar, a mosque in Paterson, N.J. ? could not have been performed under federal rules unless the FBI believed that the mosque itself was part of a criminal enterprise. Even then, federal agents would need approval from senior FBI and Justice Department officials.

At the NYPD, however, such monitoring was common, former police officials said. Federal law enforcement officials told the AP that the mosque itself was never under federal investigation and they were unaware the NYPD was monitoring it so closely. According to secret police files obtained by the AP, the NYPD instructed its officers to watch the mosque and, as people came and went from the Friday prayer service, investigators were to record license plates and photograph and videotape those attending. The file offered no evidence of criminal activity.

The FBI also would be prohibited from keeping police files on innocuous statements that imams made during sermons, which the NYPD did. In addition, the FBI would not be allowed to keep police files on Muslim students for discussing academic conferences online and would not be allowed to build databases of Americans who changed their names to ones sounding Arabic, which the NYPD did.

Since late August, 34 members of Congress, Muslim civil rights groups and most recently Ivy League universities and New Jersey officials have asked the Justice Department to investigate the NYPD's intelligence division. The Obama administration has pointedly refused to endorse or repudiate the NYPD programs, which the AP reported Monday are at least partly funded under a White House federal grant intended to help law enforcement fight drug crimes.

"Our examination of this has been limited at least at this point to the letters that have come in," Holder said. "We're only beginning our review. I don't know if federal funds were used."

Holder said there were 17 or 18 Justice Department investigations about how police around the country interact with citizens. "I'm not saying that will be something we would do here, but if we think that there's a basis for it, we will do that," Holder said.

Federal investigations into police departments typically focus on police abuse or racial profiling in arrests. Since 9/11, the Justice Department has never publicly investigated a police department for its surveillance in national security investigations.

In New York, Mayor Michael Bloomberg on Tuesday invoked the 1993 terrorist bombing of the World Trade Center and the successful attacks in 2001 that destroyed it, in a renewed defense of the NYPD. "We said back then we are not going to forget this time around," he said. "We will not. We are not going to forget." He added, "To let our guard down would just be an outrage."

Bloomberg said criticism of the police department actions was "just misplaced" and "pandering."

Universities including Yale, Columbia and Rutgers have joined in criticizing the NYPD for infiltrating Muslim student groups and trawling their websites. Police put the names of students and academics in reports even when they were not suspected of wrongdoing. And in Newark, N.J., Mayor Cory Booker said he was offended by the NYPD's secret surveillance of his city's Muslims.

New Jersey Gov. Chris Christie and the president of Rutgers University in New Jersey have urged the state attorney general to investigate the NYPD's surveillance activities. Sen. Robert Menendez, D-N.J. has also urged Holder to look into the NYPD's operations outside New York.

Hertha Berlin coach Otto Rehhagel has demanded more time to turn his team's fortunes around after they dropped into the relegation zone after their seventh straight defeat in the German league.

After a low-key training session on Sunday, Rehhagel gave his players Monday off and said now is not the time for punishing sessions after the defeat saw Augsburg climb out of the relegation zone.

"The guys need to relax mentally, they are all incredibly disappointed," said Rehhagel.

"They should go to their families and on Tuesday we will work with them again."

Having been heralded as the saviour of Hertha last weekend, Rehhagel was dealt a double blow of reality as his team conceeded two goals in two second-half minutes from Augsburg's Thorsten Oehrl on Saturday.

Cameroon's Marcel Ndjeng came off the bench to score the hosts' third in the 92nd minute to ensure it was a long drive back to the capital from Bavaria for the Hertha team and their fans.

"You can have three Otto Rehhagels and Mourinho (in charge), but if we play like that, no one can help us," admitted Hertha captain Andre Mijatovic.

With less than three months until the season's end, Rehhagel said his team are drinking in the last-chance saloon with closing time approaching.

"It is now three minutes to midnight and we are dancing on a razor's edge," said the German who led Greece to the Euro 2004 title.

Rehhagel has some tricky games ahead as Hertha face Werder Bremen and Cologne in the coming weeks before they host Bayern Munich on March 17.

Russian scientists revive an ice age flower

A plant that was frozen in Siberian permafrost for about 30,000 years has been revived by a team of Russian scientists ? and borne fruit, to boot.

Using tissue from immature fruits buried in fossil squirrel burrows some 90 feet below the surface, researchers from the Russian Academy of Sciences in Pushchino managed to coax the frozen remains of a Silene stenophylla specimen into full flower, producing delicate white blooms and then fruit.

The findings, published this week in the journal Proceedings of the National Academy of Sciences, describe what is a record for reviving presumably dead plant tissue ? and may provide clues as to what makes some plants hardier and longer-lived than others.

"I'm absolutely thrilled with the result," said Grant Zazula, a paleontologist with the Yukon government in Canada who reviewed the study for the journal. "I've always been excited for the potential of something like this being successful."

The Arctic tundra holds a trove of ancient organic material ? from tiny spheres of pollen to giant mammal bones ? that can tell scientists much about what the ecosystem there looked like tens of thousands of years ago. But it's not as well-studied as it could be, Zazula said, because icy realms like northeastern Siberia are exceedingly hard to reach.

The fruits of these ancient plants ? a species known commonly as the narrow-leafed campion that still grows in Siberia and northern Japan ? were excavated a few years ago from a bank of the lower Kolyma River.

Bacteria and other simple organisms had been known to survive in the ice for thousands of years. But reviving a life form as complex as a plant is an entirely different matter, scientists said.

"It is like generating a dinosaur from an ancient egg," said Jane Shen-Miller, a plant biologist at UCLA who has sprouted a 1,300-year-old lotus seed.

For this study, however, the researchers managed to grow a plant without even using a seed. Instead, they thawed, washed and disinfected the fruits and took out bits of nutrient-rich fruit flesh known as placental tissue. When bathed in the right broth of chemicals, placental tissue acts like the plant version of stem cells ? it can be instructed to grow into specific plant organs or, in this case, whole plants. After those plants fertilized each other, they were able to flower and bear fruit.

There were a few interesting differences between these ancient plants and the modern relatives also grown as part of the experiment. The ancient ones produced 1.5 to 2 times as many buds but were slower to grow roots. The petals on the ancient flowers were narrower than the modern petals, and some of the blooms were exclusively female ? unlike the modern flowers, which had both male and female parts.

Zazula said he was eager to see scientists compare the DNA from the ancient and modern specimens to pinpoint the genetic changes that were responsible for the plant's evolution. "That's completely unheard of before," he said.

If scientists can find the genes that made these plants able to withstand harsh conditions over thousands of years, they might be useful in developing hardier crops, scientists said.

The study is an encouraging sign that it may be possible to revive larger and more complex beings that were preserved in the frozen tundra.

"This whole thing about bringing back woolly mammoths and large extinct animals ? this kind of opens the doors on that front," Zazula said.

The study was led by Svetlana Yashina of the Russian Academy of Sciences. Corresponding author David Gilichinsky died last week, days before the paper's publication.

Worksafe Blitz Hits Bendigo | health and safety, safety news ...

WorkSafe inspectors will crack down on Bendigo businesses that place workers at risk by failing to address health and safety issues as part of a week long blitz, beginning Monday.

About 200 businesses will receive a visit by a WorkSafe inspector as part of the Safe Towns campaign which involves a team of inspectors visiting a regional area to check on health and safety compliance and return to work laws.

WorkSafe?s operations General Manager, Lisa Sturzenegger, said inspectors would target businesses that have never before been visited as well as those with previous injury claims.

?It?s in everyone?s interest to make changes sooner rather than later. Don?t wait until a WorkSafe inspector arrives, or a serious incident to address health and safety matters,? she said.

Almost 2370 injuries were reported to WorkSafe from the Bendigo region over the past five financial years, with treatment and rehabilitation costs exceeding $41 million.

More than half of these claims came from the health care and social assistance, manufacturing and construction industries.

?We constantly come across cases where companies are fined thousands of dollars for not addressing safety matters such as allowing workers to operate faulty machinery, not properly separating forklifts from pedestrians and other poor management of safety issues.?

?Getting on top of health and safety issues in the workplace is good for business, good for morale and ensures workers return home safely at the end of the day.?

?We also find that 60 per cent of all Victorian workplace injuries are a result of dangerous manual handling practices. Businesses may not even be aware that their existing work methods put a strain on their workers. ?

?We encourage businesses to look at their workplaces from a fresh perspective and to find new ways to address basic issues.?

Bendigo will be the second regional area this financial year to receive a visit as part of the Safe Towns Campaign.

The first was Echuca in August last year. Inspectors visited 197 small businesses and issued 198 improvement notices.

More visits will take place in South Geelong/Breakwater, Ballarat and Traralgon in coming months.

In the 2010/2011 financial year, WorkSafe inspectors visited 1546 small businesses across 13 regional and suburban areas as part of the Safe Towns/Safer Work Zones Campaign.

They issued 2118 improvement notices for health and safety and accident compensation breaches.

Manual handling, damaged storage racking, unsafe scaffolding, inappropriate storage of dangerous goods, insufficient return to work plans for injured workers and poor forklift traffic management were among the issues identified during the campaign.

Speedy neutrino result may be due to instrument glitch

Maybe it was unbelievable for a reason. The signs that neutrinos may travel faster than light, contradicting the well-tested rules of Einstein's special theory of relativity, look like they may have been due to a bad GPS connection.

The speedsters took 2.4 milliseconds to fly from a particle accelerator at CERN near Geneva in Switzerland to an underground detector at Gran Sasso, Italy, a distance of 730 kilometres. Shockingly, they appeared to arrive 60 nanoseconds earlier than they would have if they'd been travelling at light speed.

But that flight time was computed based on a number of different measurements, including the use of a GPS satellite to ensure that the clocks in Geneva agreed with the clocks in Gran Sasso. ScienceInsider's Edwin Cartlidge reported today that a loose cable connecting a GPS receiver to an electronic card in a computer might be able to account for the entire 60-nanosecond anomaly.

However CERN spokesman James Gillies told me, "It's not quite as simple as that....There's a possible explanation, but we will not know for sure until further tests have been made with beam."

He said something similar to MSNBC's Alan Boyle, adding that those tests have been scheduled for May.

OPERA team member Luca Stanco of the National Institute of Nuclear Physics in Padua, Italy, told me that an official update will be released tomorrow. Stay tuned.

'Green' a major theme in home construction | ReVenture Park

As the construction industry recovers, companies looking beyond the this year?s building season are getting attention.

With energy prices on the rise, companies that offer ?green? technology got much of the attention at the annual Eastern Iowa Home Improvement and Landscaping Show last week.

One of the largest displays, a story-and-a-half model of a new construction method of concrete surrounded foam designed by Integra Spec, turned heads. Darin Dietz, of Dietz Construction, hopes the display would also turn some minds to the energy-saving construction method.

?Basically, to put it into laymen?s terms, we?re building a cave above ground,? Dietz said.

That ?cave? would look like any other house but a 2,000-square-foot home would cut winter heating bills by 90 percent, Dietz said. The construction cost of such a building would be 15 to 20 percent above conventional structure costs, he added.

Rising energy costs are fueling interest in the new technique, Dietz said.

?This is going to catch on,? he said. ?We?re on the leading edge of it.?

Local interest in green building matches developments nationally. A nationwide survey conducted by McGraw Hill Construction found green residential projects made up 17 percent of new construction last year. By 2016, the value of the residential green building market is expected to grow fivefold, the survey found. The survey also showed the Upper Midwest is the seeing the second highest rate of green construction in the U.S., behind the leading West Coast.

A green building was defined in the survey as one built to LEED standards in energy and water efficiency and other factors including the site on which the building sits.

According to McGraw Hill, 46 percent of responding conventional builders say incorporating green designs has helped them secure new contracts.

For Dietz, working with the Integra Spec design sets his company apart from others. The McGraw Hill survey echoes that strategy, showing 71 percent of companies that exclusively design and build green spaces say their offerings give them a competitive advantage in the industry.

The green trend isn?t confined to new construction. Many homeowners are looking for ways to save on their energy bills in the home they are already in. The show offered dozens of energy saving tactics including ranging from efficient lighting and appliances to foam insulation and even residential energy production.

In the wake of announced plans for a rate increase from MidAmerican Energy, those products attracted some shoppers.

?I?m always looking for ideas to save money,? said Ryan Fischer, of New Hartford.

Fischer browsed a booth displaying LED light bulbs and looked over a solar powered attic fan. Fischer said he isn?t too concerned about utility prices, which he said have been relatively stable compared to gasoline prices, but was curious about the energy savings some products at the show offered.

The LED bulbs, which have dropped in price by about 50 percent in recent years would need to come down lower in price before he would switch.

Curt Wobeter, of LED Source, said that decline is likely to come but someone buying a bulb now would likely save enough money in energy use to make up for that price difference.

?What you can save in the next couple of years will far outweigh the cost (of the bulbs),? Wobeter said.

For a larger investment, Mike Miller, of Natural Solutions LLC in Cedar Falls, had a display of solar panels for homeowners who are considering generating their own energy.

Solar water heating systems are a popular improvement, Miller said, adding that interest in such systems has gone up while the cost has gone down.

?Every time energy costs go up, it shortens the time on your return on your investment,? he said.

Both Miller and Wobeter were quick to mention savings such improvements can bring won?t take years to materialize. Qualifying energy-efficient investments carry a 30 percent federal tax credit.

Problems With Flipped Houses | Structure Tech Home Inspections

Home flippers buy dilapidated houses, fix them up, then sell them again as quickly as possible with the intention of making a tidy profit. ?Flipped houses look shiny and new inside, but what?s going on underneath all the new drywall, carpet, and paint? ?Very few home buyers seem to trust flippers, and with the cheesy ?repairs? or ?cover-ups? I?ve seen over the years, it?s easy to understand why. ?Most of the quick and dirty home flippers take the same shortcuts when flipping houses; I?ve seen so many of them done the same way that I?m going to tell you all about the flipped house you just looked at without even knowing the address.

Interior

The interior of the home looks great. ?The kitchen has all new or re-painted cabinets, stainless steel appliances, granite counter tops, and a tiled floor. ?The first floor bathroom has been completely re-done, and a second floor bathroom was recently added, or possibly a basement bathroom. ?They look great. ?All new carpet, paint, light fixtures, outlets, and switches throughout the house. ?Possibly all new windows as well.

Vanity combo on sale at LowesWhen looking at flipped houses, you might notice poorly designed kitchens (ie ? cabinet doors / drawers that are blocked by other cabinets), nail holes that aren?t filled, appliances installed without an outlet to plug them in to, and loose / unsecured countertops or base cabinets. ?Bathrooms will often have vanity cabinets that are way too small for the space because the flipper bought the ?special buy? vanity, top, and faucet combo on sale at whatever home improvement store was close.

The handrails are new, but they might come right out of the wall if you pull on them. ?I?ve found a few handrails at flipped houses that were only attached to drywall.

There is a brand new circuit breaker panel installed in the basement, which replaced the old 60-amp fuse panel. ?The new panel has a state electrical inspection sticker on it, and everything looks great. ?I don?t find many electrical problems on flipped houses. ?Even the worst home flippers usually know better than to mess with the electrical; they don?t want their houses to burn down.

Heating

The home has an old, unsafe heating system at the end of it?s life expectancy. ?The flipper has documentation from ?their guy?, some heating contractor that you?ve never heard of, saying the heating system is safe. ?You should be suspicious. ?I?ve found heating safety check forms filled out that weren?t worth the paper they were written on. ?I?ve found furnaces and boilers creating high levels of carbon monoxide that the heating contractors said were fine. ?In one particular case, the home flipper claimed my equipment was faulty; we argued for a while, and eventually the flipper had the gas company come out to do their own test. ?The gas company promptly red-tagged the heating plant and shut it down.

Another possibility is that the heating system was completely replaced. ?If so, great, but check the furnace?s blower fan for drywall dust. ?There?s a good chance that the flipper had the blower fan running while they were doing their drywall sanding, and the interior of the furnace is completely caked in drywall dust. ?The photo below shows a close-up view of a furnace?s blower fan blades covered in a thick layer of drywall dust.

If the home was originally heated with a boiler, the home flipper most likely pulled out all of the pipes and radiators and converted the system to forced air; this is usually far less expensive than repairing or replacing the existing system.

Air Conditioning

If the house is being sold during the winter, the AC is very old and may not be functional. ?If the house is being sold during the summer, the AC is brand new and keeps the house very comfortable. ?I don?t find much in-between those two extremes.

Structure

This is the item that home buyers are most concerned about, especially on flipped house, but I?m afraid I can?t shed any light on this one. ?Despite what home buyers expect, I don?t find structural problems on flipped houses any more than I do with other houses.

Plumbing

The water distribution pipes will either be in acceptable condition or they?ll all have recently been replaced; no issues there. ?There will be major problems with the drains though; nobody has lived in the house yet, so nobody knows about the leaks and clogged drains.??The old steel drain lines are often clogged at the kitchen sink, and possibly at other locations.

New plumbing fixtures often leak when they?re filled with water and then drained; it?s not unusual to find several leaking drains at flipped houses.

Sometimes we?ll find floor drains, basement showers, or even basement sinks that back up with water when the plumbing fixtures at the upper levels are filled and then drained. ?That?s exactly what was happening with this new basement bathroom sink at a flipped house in New Hope.

Tiled shower floors are also notorious leakers at flipped houses; I?d estimate that half of them leak. ?I remember inspecting one house in Minneapolis about two years ago where both?of the tiled shower floors leaked like crazy. ?The buyers decided they didn?t want the house before I was even finished with my inspection.

Roofs

The shingles on the roof are in bad shape. ?You?ll find patched sections of shingles or shingles that are badly deteriorated and at the end of their life expectancy. ? Replacing the roof covering is an expensive project, but it won?t make the house sell for any more money, so flippers leave the roof alone if it?s not leaking. ?I can?t say I blame them.

The insulation in the attic hasn?t been touched for a long time ? it might even be original, and it will need improvement. ?Flippers don?t get any return on their investment for new insulation, so don?t expect anything to be done here.

Exterior

Shoddy workmanship abounds at the exterior. ?The original wood windows were replaced with vinyl inserts, but the old wood at the exterior is still rotting away and has been freshly painted, or someone did a quick and dirty job of wrapping the windows with aluminum and left a lot of rotted wood still exposed.

The basement windows have been replaced with whatever size window was close, ?and the flipper used clear pine or plywood to make up the difference in size. ?This is sloppy workmanship, at best.

Some of the siding repairs may even be comical; I actually found a hole in the siding repaired with a coffee can lid at a recent flipped home inspection.

There is a thin layer of new wood chips surrounding the house, but nothing has been done to correct improperly pitched soils around the house that can lead to a wet basement. ?You?ll want to re-grade right away.

The chimney has a lot of missing mortar and cracks in the crown. ?You?ll need to hire someone to repair the chimney to help prevent the deterioration from getting worse.

Was I close? ?If you just finished looking at a flipped house and you didn?t find any of these issues, buy the house! take a closer look. ?These are the defects that I often find at flipped houses, but keep in mind, these are broad generalizations. ?Some flipped houses aren?t in nearly this good of shape, while others are pristine. ?I?ve worked with plenty of?home flippers who do high quality construction work, including a friend,?Andy Blessing. ?His company occasionally?flips houses,?and I?d be perfectly happy to buy any house he flipped because he does honest, high quality work. ?There are plenty of good contractors who do excellent work, but it?s the rest of ?em that give home flippers a bad name.

If you?re buying a flipped house, the items you should pay the most attention to should be the exterior, roof, insulation, and drains. ?Individual results will vary.
