Lautenberg charity, other Madoff investors try to revive claims

NEW YORK (Reuters) - A federal appeals court signaled that victims of Bernard Madoff's fraud more than four years ago might be allowed to eventually sue the swindler's family members over their losses, if they're willing to wait longer.

The 2nd U.S. Circuit Court of Appeals in New York weighed whether investors, including a charitable foundation for Senator Frank Lautenberg, Democrat of New Jersey, and the town of Fairfield, Connecticut, could pursue claims against Madoff's brother Peter, his son Andrew, and the estate of his late son, Mark.

Irving Picard, the trustee liquidating Bernard L. Madoff Investment Securities LLC, has largely been successful in stopping lawsuits that he believes overlap his own and impair his ability to recover money for victims of the Ponzi scheme.

But Circuit Judge Pierre Leval suggested more than once during the hour-long argument that it might be permissible to let investors pursue claims against the family members, who were all senior employees of Madoff's firm, once Picard was done.

"What prejudice would there be to the trustee" if the claims were "allowed to sit in purgatory" until Picard collected all he could, Leval asked David Sheehan, a lawyer for the trustee.

When Sheehan answered that there was none, Leval responded, "In that case, there is no need to make this (lawsuit) void."

So far, Picard has recovered about $9.3 billion for Madoff victims, and distributed $2.95 billion. He has estimated that Madoff's Ponzi scheme caused $17.5 billion of losses, meaning that many investors remain far from being made whole.

Bernard Madoff, 74, is serving a 150-year sentence in a North Carolina federal prison.

NOT AN HONEST NICKEL

The Lautenberg Foundation, which claimed $9 million of losses, accused Picard of overreaching by barring its securities fraud claims.

It said these differed from their claims because they sought property from people who worked for Madoff, not from the bankruptcy estate itself.

"The causes of action should be permitted to proceed in parallel," the foundation's lawyer, Jennifer Ann Hradil, told the three-judge 2nd Circuit panel.

Sheehan disagreed.

"The Madoff family: These are the people that ran the fraud," he said. "They never made an honest nickel. And that is the money that we're trying to bring back into the estate."

WEALTHY UNCLE

It is unclear how much money the Madoff family members might still have once Picard finishes his own recovery efforts.

Circuit Judge Reena Raggi said the trustee had made a "strong presentation" that Peter, Andrew and Mark Madoff had amassed their respective wealth through the Madoff firm.

But she said it would be "very odd" to bar lawsuits if it were found, for example, that Peter Madoff had been left money from a wealthy uncle that had nothing to do with the fraud.

Peter Madoff had been chief compliance officer at his brother's firm, and was sentenced last month to 10 years in prison over his role in the fraud.

Andrew and Mark Madoff were co-directors of trading at the firm. Mark Madoff committed suicide in December 2010.

On Friday, the 2nd Circuit also heard arguments in a second group of cases by investors in some "feeder funds" that funneled money to Madoff. Picard has long denied such claims, saying the funds themselves are the "customers" entitled to recovery.

The 2nd Circuit often takes several weeks or months to rule.

It has yet to rule on whether former Madoff customers could revive claims against the estate of Florida businessman Jeffry Picower, a one-time Madoff client whose $7.2 billion settlement with Picard is the trustee's largest.

Mississippi Abortion Clinic Gets License Warning

JACKSON, Miss. -- Mississippi's only abortion clinic said it received notice Friday that the state Health Department intends to revoke its operating license.

However, the clinic, Jackson Women's Health Organization, is not expected to close anytime soon.

Under a state administrative procedures law, the clinic can remain open while it awaits a hearing by the department. That could be more than a month away.

Clinic owner Diane Derzis said this week that she expected the notice about a possible license revocation.

Health Department workers inspected the facility Jan. 16 to see if it had complied with a 2012 state law that requires anyone doing abortions at the clinic to be an OB-GYN with hospital admitting privileges.

Derzis said local hospitals would not issue privileges to out-of-state physicians who do most of the abortions at the clinic.

Admitting privileges can be difficult to obtain. Some hospitals won't issue them to out-of-state physicians, while hospitals that are affiliated with religious groups might not want to associate with anyone who does elective abortions.

"They were clear that they didn't deal with abortion and they didn't want the internal or the external pressure of dealing with it," Derzis told The Associated Press on Jan. 11.

Republican Gov. Phil Bryant, who signed the 2012 law, has said repeatedly that he wants Mississippi to be abortion-free and that he'd shut the clinic if he had the power to do it.

Supporters of the law say it's intended to protect women's safety. Opponents say admitting privileges are unnecessary because the clinic has an agreement to transfer patients to a local hospital if an emergency arises; the patients would be tended by physicians on duty at the hospital.

The clinic filed a federal lawsuit last summer as the law was about to take effect, arguing that the law is unconstitutional because it would effectively block women's access to abortion in Mississippi by closing the facility where most of the 2,000-plus abortions a year are performed in the state. A 1973 U.S. Supreme Court decision in Roe vs. Wade established the nationwide right to abortion.

U.S. District Judge Daniel P. Jordan III gave the facility time to try to comply with the law, blocking any criminal or civil penalties during that period. Clinic attorneys are asking Jordan to extend his injunction on the law.

The clinic filed a plan with the state Health Department showing that it intended to seek admitting privileges for its physicians, and the department allowed six months for that process, until Jan. 11. The Jan. 16 inspection was triggered by the clinic's missing the Jan. 11 deadline.

The Health Department wrote a letter Thursday that was delivered to the clinic Friday, showing the findings of the inspection. The department noted that none of the three physicians affiliated with the clinic have local hospital admitting privileges. It said one of the physicians previously had the privileges, but those had expired July 27.

The department also noted that the clinic had too few parking spaces available. State regulations require the clinic to be "located in an attractive setting with sufficient parking space provided." The department told the clinic to submit a plan within 10 days showing how it would correct the parking situation. The clinic's parking lot holds fewer than 20 cars.

Negotiations are some of the most challenging business conversations to have because the two parties at the table often act as adversaries looking to get the largest ?share of the pie.? In our first semester?s Management and Organizations class, we were taught to expand the pie, involve multiple issues in the negotiation, and in the end, create value through the exchange. Business strategy and decision-making is all about value capture among two negotiating parties (business and consumer) and value is not necessarily defined as monetary. So why then are most business decisions (and therefore, negotiations) in the ?real-world? hinged upon the single issue of money?

Within my four years of experience at a top-consulting firm, it is impossibly hard for me to remember a business conversation that did not hinge upon the flow of dollars related to a particular decision. Even as an undergraduate at one of the top business schools, I cannot remember a significant discussion that went beyond business ethics and focused on something other than the amount of dollars generated or saved. While I wholeheartedly agree with the merits of capitalism, I feared from my past experience that the scope of business decision-making was limited to the money that was created or retained by an organization.

After joining the Social Venture Fund at the University of Michigan Ross School of Business, I?ve come to realize that it is possible to look beyond the greenback. Having gained exposure to social entrepreneurs focused on solving some of societies greatest issues using self-sustaining business models that concurrently generate profits and social good, I?ve begun to ask myself why larger corporations have not started to adopt this framework of thinking to increase the value of the pie, instead of merely distributing it. For example, Google, a company I greatly admire, states in its classic ?10 Things?, ?you can make money without doing evil?; what if instead, Google had stated ?you can make money by doing good?? While the literal meaning has changed only subtly, the implications of the change are far greater. If Google began to approach its business with a focus on making money by doing good, its decision-making framework would have to expand beyond dollars, establishing a second issue for negotiations with its customers. Based on negotiation strategies taught in business school, would this not be preferable to a distributive negotiation in which each party fights for their own ?share of the pie??

Something to think about, but that?s just my two copper Abraham Lincoln?s?

Environmental crises may threaten pensions

SAVE the planet, save your pension. A new report claims that environmental problems could bust pension funds by 2050.

Aled Jones of Anglia Ruskin University in Cambridge, UK, and his colleagues drew together evidence about a wide range of environmental problems, from water shortages to atmospheric pollution to climate change. They plugged these into models used to predict the values of pension funds.

Jones ran several scenarios, varying how quickly governments and industry responded to environmental problems. The results are published by the UK's Institute and Faculty of Actuaries (IFA). In almost all cases the value of funds began to fall before 2100. In the worst-case scenario, where governments and markets did nothing, values dropped steeply from around 2020 and fell to zero by 2050.

"Despite strong evidence that there is a risk that resource constraints could have significant economic impacts, these risks are not being factored in by many actors in the global economy," says Peter Tompkins of the IFA.

Pebble launches iPhone app, starts to ship first batch of smart watches

Pebble, the E-Paper smart watch for iPhone (and Android), has sent word that they've begun shipping their first set of orders. Before you get too excited, it's an incredibly limited shipment, less than 500 units today, with more to follow. But still, progress. Here are the production notes they emailed backers and posted on their Kickstarter page:

  • As of today, the factory is manufacturing roughly 800-1,000 Pebbles per day. We're working hard to get this up to our full capacity (2.4k per day)
  • We are shipping master cartons of Pebbles by air freight across the Pacific to our US distribution center 1-2 times per week, and 1-2 times per week to our Hong Kong distribution center which fulfills shipments to any country that isn't the US. There is a 5-7 day lag between a Pebble coming off the assembly line, and it arriving in a fulfillment center for shipping.
  • Right now, we're manufacturing in large batches of 1 colour at a time. Since black was by far the most popular colour, we started with a run of black Pebbles. Pearson warns of another tough year after earnings fall

LONDON (Reuters) - British education and media group Pearson warned on Monday it expects tough market conditions to continue in 2013 after a weak fourth-quarter hit earnings last year.

The owner of the Financial Times newspaper and Penguin books publisher said it now expects to report on February 25 adjusted earnings per share of around 84 pence for 2012, below the 84.9 pence it had predicted in October, due to weaker educational funding in developed markets and sluggish advertising.

The result had already expected to be down on the previous year's earnings of 86.5 pence a share due to the sale last year of its 50 per cent stake in the FTSE International market indexes business to the London Stock Exchange, which it said contributed 2.2 pence a share to earnings in 2011.

The rare downgrade, from a group that is more used to surprising in the other direction, knocked its share price down 3.6 percent to 1193 pence by 1004 GMT, slightly below the level they were trading at the start of the year following a jump last week.

"If you look at the statement it's pretty clear that 2013 is going to be another grim year," Liberum analyst Ian Whittaker said.

"Overall it's a weak statement, it's a downgrade to guidance and the mere fact they've had a downgrade to what is seen as a defensive stock is likely to drive a negative reaction."

The long-running concerns over the strength of education spending, particularly in the United States, have led to Pearson shares underperforming the STOXX Europe 600 media and publishing sector index in the last 12 months with Pearson down over 3 percent while the index has risen nearly 15 percent.

"While we are upbeat on the group's structural position and longterm prospects, we think valuation is up with events at 13.8 times 2013 expected price-to-earnings ratio," Citi said in a note.

"Our overall view on Pearson is balanced. We think the company will continue to post further market share gains as it did in 2012 but we are not convinced overall earnings momentum will improve until the second half of 2013 expected, or even maybe 2014 expected."

The weakening conditions come at a time of widespread change for Pearson - for years one of the most stable media groups in Britain.

Marjorie Scardino stepped down at the end of last year after 16 years as chief executive, making way for the head of the international education arm, John Fallon, to take over. The appointment however has also resulted in the departure of the FT Group chief executive, Rona Fairhead, who missed out on the top job.

At the same time the group is merging its Penguin book publisher with Random House, owned by Germany's Bertelsmann, and it faces constant media speculation as to whether it will sell its FT Group under the new CEO, who has few ties to the newspaper industry.

Weak government spending in developed markets weighed on its school publishing business last year, while professional education struggled due to changes in training programmes in Britain, which has resulted in the planned closure of the Pearson in Practice business.

In North America it said it would report modest revenue growth last year after increasing its market share in what was a particularly tough year, with net sales for the combined U.S. School and Higher Education publishing industries declining by 11 percent in the first 11 months of the year.

On the positive side it said its International arm would report double-digit percentage sales growth due to strong demand in developing markets, assessment and English Language Teaching. Books group Penguin traded in line with expectations and digital and subscription revenues helped the Financial Times to counter weaker advertising sales.

As a result it said it expected to report good revenue growth for the group as a whole at constant exchange rates for 2012 and operating profit of around 935 million pounds ($1.48 billion), below a consensus market forecast of 942 million pounds.

"While the downgrade (in the results forecast) may seem modest, the mere fact they have done one for a share with such a high rating and a reputation for upgrades means they should see a "double whammy" (of a de-rating and reduction in forecasts)," Whittaker said.

Las Vegas police were searching for answers Tuesday after one of their own killed his wife and son, called 911 to confess, then set his house on fire and committed suicide as rifle-toting cops moved in.

"I can't think of a reason for this, where something can get so bad that you'd do this," one veteran supervisor told the Las Vegas Review-Journal after the Monday murder-suicide.

Police have not released the name of the shooter but said he was a 52-year-old lieutenant with more than 20 years on the force. His wife was a retired officer, the newspaper said. Their son was about seven years old.

They lived in Boulder City, a small community 20 miles from Sin City that boasts a low crime rate.

At 8:20 a.m. on Monday, the lieutenant called 911 and said he had killed his wife and child, was setting his house ablaze and would shoot anyone who approached, a police spokesman said.

When police arrived, they found the man in the doorway of the ranch-style home, holding a pistol.

"Put your gun down!" an officer shouted, according to a neighbor.

The man retreated into the burning home where he apparently killed himself, police said. The responding officers never fired a shot but circled the house with guns drawn while firefighters put out the flames that engulfed the roof.

Neighbors said the family kept to themselves. There were no details on the lieutenant's work record.

A colleague told the Review-Journal he had seen the man Saturday night and he seemed "totally fine."

"You just wonder how and why this could happen," the officer said.

Manti Te'o's girlfriend story: A tall tale everyone wanted to believe

"Manti, describe your girlfriend to me."

I knew nothing about Lennay Kekua. Was she pretty? Smart? Funny? Blonde? Brunette? Did she like football? The only thing I thought I knew was that she had died, and that Manti Te'o, the best linebacker in college football and her boyfriend, had dominated a football game for Notre Dame a couple days later.

What I didn't know, and what Te'o apparently didn't know, either, is that Lennay Kekua wasn't pretty or smart or funny or blonde or brunette or a football fan or a far-too-young leukemia victim. She didn't exist.

That much came to light Wednesday courtesy of a Deadspin.com report. Te'o claims he became aware in December, and then says he realized he was the subject of a hoax after Notre Dame hired private investigators and computer forensic experts to figure out exactly who, or whom, Lennay Kekua was and why she pretended to die ? and later come back to life.

The narrative whipsaw of a sad story turning into something far worse ? a morbid, twisted tale of an Internet prank gone excessive ? ignited the sports world Wednesday, and left everyone wondering whether this was really the case of a na?ve football player done wrong by friends or a fabrication that has yet to play to its conclusion.

Confused? Everyone is. And maybe Manti Te'o was also that September night outside Spartan Stadium in East Lansing, Mich., the night the legend of a dead girlfriend who never existed was truly born.

Te'o's Fighting Irish had just beaten Michigan State 20-3 to move to 3-0, a landmark victory on their way to an undefeated regular season. Te'o was the star, with 12 tackles, a sack and a fumble recovery.

That much is undeniably true. Then the story filtered out that just hours later, he'd lost Kekua. Newspapers and the ESPN broadcast were all over it. After the game, Te'o stood in one end zone and triumphantly pointed to the heavens.

"I lost two, you know, women that I truly love," Te'o said after the game. "But I had my family around me, I had my football family around me, I had my girlfriend's football family around me. And at the end of the day families are forever. I'm going to see them again and it's going to be a very happy day when I do."

This was the start of the snowball that has now humiliated the 22-year-old.

I'm going to see them again, he said, which implies he saw both grandma and girlfriend before. In fact, he hadn't. It appears to be the precise moment that, publicly, at least, when Te'o inflated the relationship.

It got bigger. Much bigger. He later painted the picture of their first face-to-face meeting to the South Bend Tribune, Te'o "extend[ing] his hand to the stranger with a warm smile and soulful eyes."

That didn't happen, either. There have been quotes from Te'o's father, who claimed Kekua visited Hawaii, which also wasn't true, because, of course, she didn't exist. There was talk of the colorful flowers sent to her funeral, which never occurred. Throughout the fall, as the media asked, Te'o gave the impression it was a traditional relationship, not one limited to online chats and phone calls.

Maybe he was embarrassed about that, and it motivated what he thought were white lies. Who wants to admit it was just chats and calls? Maybe once he spun it a little forward, he couldn't go back. Maybe we don't know. Te'o is expected to answer those questions this week, perhaps Thursday. In a statement, Te'o, currently training in Florida for the NFL draft, expressed disappointment at the entire ordeal.

"This is incredibly embarrassing to talk about, but over an extended period of time, I developed an emotional relationship with a woman I met online," Te'o said. "We maintained what I thought to be an authentic relationship by communicating frequently online and on the phone, and I grew to care deeply about her."

The story is beyond bizarre.

"I don't want to confuse this at all," Notre Dame athletic director Jack Swarbrick said Wednesday at a lengthy and open news conference in South Bend. "Manti Te'o is the victim of this scam."

(AP)While the original Deadspin story framed Te'o as a participant in the scam ? something to draw positive publicity to a Heisman Trophy campaign ? Notre Dame and its investigators are adamant that isn't the case.

In the end, Te'o may have done nothing wrong beyond perpetuating a lie that was far worse for him than anyone he told. I can certainly envision a 22-year-old getting duped, yet also embellishing tales about his girlfriend ? especially to a media eager to glorify it all. It seems more common than hatching this plan as a way to win the Heisman.

Swarbrick said the Notre Dame investigators have identified the perpetrators of the trick and said they did it out of enjoyment. The school was initially wary that this was an extortion attempt, or gamblers, or someone bent on drawing Te'o into an NCAA violation. Notre Dame now doesn't believe that.

"It was a cruel, cruel hoax," Swarbrick said. Later, he choked up in emotion over watching one of his favorite players ? "the single most trusting human being I've met" ? get conned.

How trusting is Te'o? At one point in December, he got a phone call from the number he thought belonged to Kekua, who he believed was dead. He answered and was greeted by the female voice that he thought was Kekua.

On that September night after beating Michigan State, Notre Dame coach Brian Kelly hailed Te'o's courage for playing while in mourning ? for his grandmother, with whom he was close, and Kekua, with whom he believed he was close. Wide receiver John Goodman said he had the "ultimate respect" for Te'o. Nose guard Louis Nix called it "a family tragedy." And wide receiver Robby Toma, a fellow Hawaiian who lived with Te'o, discussed their emotional talks that week. "He told me he needed me," Toma said. "I've known him since he was 5 years old."

At one point, I talked to Swarbrick about Te'o, about this Hawaiian Mormon who chose to play for the Irish Catholics, who turned down the NFL draft to return and lead Notre Dame back to glory, who demonstrated such obvious leadership.

"The perfect Notre Dame football player," Swarbrick said.

Then I asked the athletic director about whether the girlfriend's long battle with leukemia, as it had been described, had worn Te'o down. That's a slow, emotional way to die. It's especially tough on the survivor when you're off in Indiana, helpless and incapable of getting back to help or hug.

Swarbrick hesitated, maybe surprised at the thought. He acknowledged he hadn't noticed anything.

"I don't think [it was wearing on him]," he said. "But in typical fashion it was not something he was sharing or using as a crutch at the time. He was just being Manti."

I finally went back to where Te'o was finishing up, with a Notre Dame athletic administrator about to pull him away. The buses were waiting. Media access to athletes is always brief.

"Manti, describe your girlfriend to me."

I thought he heard me. Maybe he didn't. Either way, he didn't answer. I assumed it was because it was time to leave. At the moment, there was no reason to wonder if he couldn't describe her or was wary of going into greater detail or had just realized that he'd already started the embellishments. Soon he was gone, off to finish his perfect regular season and wind up second in the Heisman voting ? a season he dedicated to his grandma and his girlfriend.

The story seemed too good to be true.

Soccer-Saudi Arabia sack Dutch coach Rijkaard

Jan 17 (Reuters) - Saudi Arabia have sacked Frank Rijkaard as coach of the national soccer team after 18 months in charge, the country's football federation has announced.

Rijkaard signed a three-year deal in July 2011 but a disappointing Gulf Cup of Nations campaign this month prompted the Dutchman's dismissal halfway through the contract.

Saudi Arabia failed to make it past the group stage in Bahrain, recording a solitary win over Yemen but losing twice to Iraq and Kuwait.

"After a long FA board meeting on Wednesday we agreed with Mr. Frank Rijkaard to terminate his contract, and send it to a legal advisor to decide each part's rights after terminating the contract," the Saudi FA said in a statement on their website.

Eliminated early from 2014 World Cup qualification, the Saudis are determined to make it to the 2015 Asian Cup in Australia and are grouped with Iraq, China and Indonesia.

Saudi Arabia's national news agency reported Spaniard Sergio Piernas, who is now coaching the country's youth team, would take over from Rijkaard on a temporary basis and lead them through Asian Cup qualifiers against China and Indonesia in February and March.

Despite Java update, experts say bugs remain

Oracle Corp. released an emergency update to its Java software for surfing the Web on Sunday, but security experts said the update fails to protect PCs from attack by hackers intent on committing cyber crimes.

The software maker released the update just days after the U.S. Department of Homeland Security urged PC users to disable the program because of bugs in the software that were being exploited to commit identity theft and other crimes.

Oracle's failure to quickly secure the software means that PCs running Java in their Web?browsers remain vulnerable to attack by criminals seeking to steal credit-card numbers, banking credentials, passwords and commit other types of computer crimes.

Adam Gowdiak, a researcher with Poland's Security Explorations who has discovered several bugs in the software over the past year, said that the update from Oracle leaves unfixed several critical security flaws.

"We don't dare to tell users that it's safe to enable Java again," said Gowdiak.

Some security consultants are advising businesses to remove Java from the browsers of all employees except for those who absolutely need to use the technology for critical business purposes.

HD Moore, chief security officer with Rapid7, a company that helps businesses identify critical security vulnerabilities in their networks, said it could take two years for Oracle to fix all the security bugs that have currently been identified in the version of Java that is used for surfing the Web.

"The safest thing to do at this point is just assume that Java is always going to be vulnerable. Folks don't really need Java on their desktop," Moore said.

An Oracle spokeswoman declined to comment.

Oracle said on its security blog on Sunday that its update fixed two vulnerabilities in the version of Java 7 for Web browsers.

It said that it also switched Java's security settings to "high" by default, making it more difficult for suspicious programs to run on a personal computer without the knowledge of the user.

Java is a computer language that enables programmers to write software utilizing just one set of code that will run on virtually any type of computer, including ones that use Microsoft's Windows, Apple's OS X and Linux, an operating system widely employed by corporations.

One version is installed in Internet browsers to access Web content. Separate versions are installed directly on PCs, server computers and other devices including phones, webcams, and Blu-ray players.

The Department of Homeland Security and computer security experts said on Thursday that hackers figured out how to exploit the bug in a version of Java used with Internet browsers to install malicious software on PCs. That has enabled them to commit crimes from identity theft to making infected computers part of an ad-hoc networks that used to attack websites.

Oracle said that the flaws only affect Java 7, the program's most-recent version, and versions of Java software designed to run on browsers.

Java is so widely used that the software has become a prime target for hackers. Last year, Java surpassed Adobe Systems Inc's Reader software as the most frequently attacked piece of software, according to security software maker Kaspersky Lab.

Java was responsible for 50 percent of all cyberattacks last year in which hackers broke into computers by exploiting software bugs, according to Kaspersky. That was followed by Adobe Reader, which was involved in 28 percent of all incidents. Microsoft Windows and Internet Explorer were involved in about 3 percent of incidents, according to the survey.

The Department of Homeland Security said attackers could trick targets into visiting malicious websites that would infect their PCs with software capable of exploiting the bug in Java.

It said an attacker could also infect a legitimate website by uploading malicious software that would infect machines of computer users who trust that site because they have previously visited it without experiencing any problems.

Security experts have been scrutinizing the safety of Java since a similar security scare in August, which prompted some of them to advise using the software only on an as-needed basis.

Meanwhile, Microsoft said on Sunday that would it release an update on Monday to fix a previously disclosed flaw in Internet Explorer versions 6, 7 and 8 that made PCs vulnerable to attacks in which hackers can gain remote control of the machines. Microsoft previously released a temporary fix to prevent such attacks.

Rare Japanese Rabbit Leaves Endangered Species List

amami rabbitJapan has removed the rare, nocturnal, island-dwelling Amami black rabbit (aka the Ryukyu rabbit, Pentalagus furnessi) from its endangered species list, according to a report from The Telegraph. The rabbits can only be found on the remote islands of Amami Oshima and Toku-no-Shima, part of the Ryukyu archipelago located about 350 kilometers south of mainland Japan and 300 kilometers north of Okinawa. They have been legally protected for nearly a century, initially as a response to overhunting. In recent decades they have suffered from habitat loss and predation by dogs, cats and invasive Indian mongooses (Herpestes javanicus), 30 of which were introduced to Amami island in 1979 to control venomous snake populations.? (At least four poisonous snake species, collectively known as habu, live on the Ryukyu islands.) By 1999 an estimated 5,000 to 10,000 mongooses inhabited the island, massively disrupting the native fauna.

The Telegraph did not mention why Japan removed the Amami rabbit from its endangered species list, which is usually a sign of population recovery. Japan?s Ministry of the Environment did not return requests for comment or information.

The Amami rabbit diverged from other Asian rabbits millions of years ago and has been described as a ?living fossil.? It bears shorter ears and legs than most other rabbit species, as well as a longer snout and atypically dark black-red fur. Interestingly, the species does not have a tail. The Japanese rabbits are slightly larger than the average North American cottontail, reaching up to 50 centimeters long and 2 kilograms in weight. Behavior also sets them apart from many other species: they tend to live more solitary lives, rather than in large groups. Mother Amami rabbits even seal their young ? which are only born once or twice a year, usually one ?kitten? at a time ? into underground dens, possibly to keep them safe from snakes. They appear to thrive only in either young or mature forests, both of which are increasingly lost to logging and commercial and residential development.

Japan started an effort to control the mongoose population on Amami Oshima in 2005. Hopefully the removal of the Amami black rabbit from Japan?s endangered species list is a sign of success in that arena. The rabbit remains listed as ?endangered? on the IUCN Red List of Threatened Species.

CVC, RBS raise $290 million in Samsonite stake sale-term sheet

HONG KONG (Reuters) - Private equity firm CVC Capital Partners and Royal Bank of Scotland sold a combined $290 million stake in Hong Kong-listed luggage maker Samsonite International , a term sheet seen by Reuters showed.

The 138.3 million shares were sold at HK$16.20 each, a 4.9 percent discount to Samsonite's Friday's close of HK$17.04, the terms showed. That would put the total deal at HK$2.24 billion, with about 65 percent of the shares sold by CVC and the remainder by RBS .

Samsonite's shares fell 1.6 percent in early trading in Hong Kong to HK$16.76, compared with a 0.3 percent gain in the benchmark Hang Seng index <.hsi>, but were still above the selldown price.

The latest sale meant CVC reduced its stake in Samsonite to about 9.7 percent and RBS to 5.1 percent, according to Thomson Reuters data.

Goldman Sachs was the sole underwriter on the selldown.

Luxembourg-based Samsonite listed in Hong Kong in 2011 in a $1.25 billion IPO. CVC and RBS jointly raised about $821 million by selling into the IPO, although Samsonite's shares languished following the deal.

CVC and RBS have agreed to a 90-day lock-up during which they will refrain from selling any more shares into the market, the terms showed.

(AP) ? Tom Brady is so good at this playoff thing he seems to be going for a championship every year.

He gets another chance to lead the Patriots to the Super Bowl after earning his record 17th postseason victory in New England's 41-28 victory over Houston Sunday. Brady even outdid his childhood hero, Joe Montana, and a fourth NFL championship would equal Montana's haul.

"I love playing, I love competing, I love being a part of this organization," said Brady, who threw for three touchdowns and 344 yards. "I think I've just been fortunate to play on some great teams over the years. I never take it for granted."

Next up is Baltimore, which stunned top-seeded Denver in double overtime Saturday, and lost 23-20 at Gillette Stadium last January in the last step before the Super Bowl. But the Ravens beat the Patriots in Week 3 this season at Baltimore.

"I think the two best teams are in the final," Brady said. "Baltimore certainly deserves to be here and so do we."

Seldom-used Shane Vereen scored three times, twice on pinpoint throws from Brady, as New England (13-4) beat Houston (13-5) for the second time in a month.

Brady was missing some key helpers, including tight end Rob Gronkowski, who broke his left arm and is out for the rest of the playoffs, a person with knowledge of the injury told The Associated Press.

However, he got the usual outstanding performance from Wes Welker, his favorite target the last six years. The AFC's top receiver with 118 catches this season, Welker looked like he might reach that total against Houston's befuddled defense. He caught six in the first half for 120 yards, including a 47-yarder, and wound up with eight for 131.

And the AFC East champion Patriots got more than anyone could have predicted from third-string running back Vereen, who scored their first two TDs on a 1-yard run and an 8-yard pass. He capped his biggest pro performance with an over-the-shoulder 33-yard catch early in the fourth period.

It was Brady's 41st postseason TD pass, behind only Brett Favre (44) and, you guessed it, Montana (45).

Nice company to be keeping.

"I grew up a 49ers fan," Brady said after throwing for three touchdowns in the AFC divisional playoff. "Joe Montana and Steve Young ... those guys are in another class.

"I hope I am around for a few more years," the 35-year-old Brady added with a smile.

The boost from Vereen offset the loss of not only Gronkowski, but running back Danny Woodhead (thumb) in the first quarter.

"Shane had a great game, just a huge growing up moment for him, very special," Brady said. "There were a lot of guys who made a lot of plays."

New England's defense helped put away the Texans. Rob Ninkovich's leaping third-quarter interception stopped a drive, and six plays later, Brady hit Brandon Lloyd for a 6-yard score.

Although the Texans got two fourth-quarter TDs on passes by Matt Schaub, their season ended with four defeats in their last six games. That slump cost the AFC South champions the top seed in the playoffs, forcing a trip to New England after they beat Cincinnati in the wild-card round.

The Texans couldn't measure up.

"Whenever the season ends, no matter when, it's really hard," tight end Owen Daniels said. "The farther along you get, the harder it is to take. It's one we wanted to win really bad. It's tough to swallow ... but one team gets to have a smile on their face at the end of the season, and it's not us this year."

Unlike their 42-14 loss here a month ago, the Texans didn't fold early. J.J. Watt, their dominating defensive end, bothered Brady, and when they fell behind 17-3, they had the fortitude to climb back.

Arian Foster did all the work after Danieal Manning's second big kickoff return, this one a 35-yarder that had 15 yards tacked on when kicker Stephen Gostkowski brought down Manning with a horse-collar tackle. The Pro Bowl runner covered all 47 yards on a five-play drive and his 1-yard run ? he barely squeezed into the end zone ? made it 17-10.

Houston forced a three-and-out, and a short punt gave the Texans another shot just before halftime. They got close enough for Shayne Graham to kick a 55-yard field goal as the half ended.

But the Patriots pulled away in the third quarter for coach Bill Belichick's 17th postseason win, third behind Tom Landry (20) and Don Shula (19).

Now come the Ravens.

"It's sweet just playing in the AFC championship," defensive tackle Vince Wilfork. "It's a team that beat us earlier this year at their house, and a team that's riled up for us."

Needing a quick jolt after being blown out by the Patriots on Dec. 10, the Texans got it on the opening kickoff from Manning. He took the ball 6 yards in his end zone and never hesitated in returning it. He broke free at the Houston 30 and wasn't run down until reaching the New England 12.

That spark didn't even last one play, though, and Houston wound up with Graham's 27-yard field goal 63 seconds in.

And when the Texans closed the first half with a 10-point spurt, they wasted the momentum by allowing a quick touchdown drive to open the third period. Brady went to the familiar (Welker and tight end Aaron Hernandez) on that series before second-year back Stevan Ridley scored on an 8-yard burst.

New England lost Gronkowski and Woodhead almost immediately. Gronkowski missed five regular-season games with a broken left forearm, but returned for the finale. Eight Patriots plays on offense and he was gone again.

So Brady found other targets; he probably could complete passes to Belichick for big gains.

Vereen was an unlikely star. After gaining 400 yards overall during the season, he picked up 124 against the Texans. He had four touchdowns in the regular season.

"I don't come into the game knowing how much anyone is going to play," Vereen said. "I come into the game ready to go, and if my number is called, I do my best for the team."

NOTES: Brady is 3-2 in Super Bowls and if he reaches a sixth, he'll join a club that currently totals one player: defensive tackle Mike Lodish. ... New England has played in eight AFC championship games, going 7-1, including 5-1 with Brady and Belichick. ... Brady threw for 344 yards, and Schaub threw for 343. (AP)?Thousands of people marched in Madrid on Sunday to protest plans to privatize parts of their public health care system, with some questioning the motives behind the government's actions.

The march by employees and users of the system is the year's second large "white tide" demonstration, named after the color of the medical scrubs many protesters wear. Several similar marches took place last year.

Demonstrators thronged main boulevards in the center of the Spanish capital, carrying banners saying, "Public health care should be defended, not sold off."

The Madrid region has proposed selling the management of six of 20 large public hospitals in its jurisdiction and 10 percent of its 268 public health centers. It says these reforms are needed to secure health services during Spain's economic crisis.

But protesters were skeptical.

"This measure is politically inspired and not financial," said mechanical engineer Mario Sola, 47. "If public hospitals were unsustainably loss-making as we're being told, private enterprise wouldn't be interested."

Health care and education are administered by Spain's 17 semi-autonomous regions rather than by the central government.

Many regions are struggling financially as Spain's economy has shrunk due to a double-dip recession following the 2008 implosion of the once-prosperous real estate and construction sectors.

Some regions overspent during boom years, but are now excluded from borrowing on the financial markets to repay their accumulated debts, forcing them to seek savings and even request rescue aid from the central government.

Regional health councilor Javier Fernandez-Lasquetty called the protests irresponsible and said that "everyone has their point of view, but we are all fighting to defend the same thing."

Jose Gabriel Gonzalez Martin, president of Spain's Independent Civil Service Trade Union Center, said many people's suspicions were aroused when former government health officials acquired jobs with private companies lining up to take over medical analysis functions.

"It might be purely coincidental, but some coincidences are surprising," Gonzalez said.

While social media isn?t always the best place to resolve an issue, it is a great proactive channel to identify customer service problems before they spiral out of control. Many customers immediately flock to Twitter to complain about a company regarding bad support experience ? we can expect more companies to use Twitter as problem detection/resolution platform.

3. Vendor Consolidation

Customer service companies, especially those with cloud or social media capabilities, will continue to be snapped up by industry leaders seeking to grow their product functionality.The customers of these major players benefit from consolidation by not having to integrate multiple products on their own, and dealing with different vendor contracts.

The last few years have seen some juicy deals in the space and you can expect more in 2013. Some examples:

Other notable deals include Oracle?s acquisitions of Collective Intellect and Inquira, Pegasystems? acquisition of Chordiant for $161.5M, and Salesforce?s acquisition of Assistly for $50M.

4. Speed Is King

One in three of us feel we have less free time than our parents did, according to a recent survey conducted by Persuadable Research Corporation.Some of the results from that survey indicate that we feel a time crunch because of higher living costs, longer work hours, family responsibilities, and commuting time.

Its no surprise that customers find speed of service more important now, regardless of whether they are on the phone, web, or at the service location:

Companies should make fast and efficient service a priority ? it reduces the chances of your customers getting annoyed and abandoning the service process, or worse yet, switching to a competitor.

5. Customer Power Shift

Customers have access to more knowledge about companies than ever before, and knowledge is power. Social media, online customer reviews, message forums, and the power of Internet search are tipping the balance of power away from the corporation and in the favor of the customer, where it belongs.

Customers are smarter and resourceful. Slick branding, marketing, and messaging are not enough to sustain customers. They have access to copious amounts of information at their fingertips.

Tricia Morris of Parature said it best, ?The shift from CRM to VRM (where customers will choose and maintain their relationships with vendors on their own terms) will continue, as consumers and customers determine if, when and where they engage with brands.?

Health Insurance Is Not Healthcare | MyFDL

It's a wager

Insurance companies make a simple wager with you each time you sign a policy. They are betting that, over the life of the policy, they will pay out less to you and your beneficiaries than you will pay them.

Insurance companies of all kinds make tidy profits on this simple wager. If they don?t, sometimes the government will bail them out.

Either way, insurance is still just a bet. And in America, we do not have a healthcare system. We have a health insurance industry.

That industry has been one of the most profitable sectors of the economy for well over a decade. But costs skyrocketed and care suffered. We heard horror stories about rationed care, denied procedures and corporate bureaucracies run amok. Ironically, these were the horror stories we were supposed to hear if the government took the reigns of the ?best healthcare system in the world.?

So, instead of a single-payer healthcare system, we got The Affordable Care Act?aka Obamacare. Instead of retiring the health insurance industry and its actuarial tables and profit margins and wagers, Obama ?saved? the health insurance industry and enshrined it in perpetuity as the ?Health Insurance-Industrial Complex.?

As the Affordable Care Act?s provisions begin to take effect, the folks in the Complex are wasting no time doing what they can to keep their profits tidy. Leading insurers in California are seeking increases in premiums ranging from 20% to 26%. Regulators in Florida and Ohio have already approved increasing premiums as much as 20%, and, since the ACA doesn?t set federal standards, insurance companies are moving in a number of states to force these spikes in premiums.

Remember, if you can ?afford? health insurance, you have to buy it. If you refuse, you?ll pay a penalty to the government at tax time. Some are exempt from this mandate. But, in effect, the ACA has guaranteed the health insurance industry a captive market.

Meanwhile, they continue to change the terms of all those bets they?ve placed against millions of Americans and the cost of the ?best healthcare in the world? continues to rise. When compared to other nations with some form of single-payer system, the difference is so stark that it?s almost obscene. It?s not just the $800 difference between an MRI in France versus the U.S., it?s almost every part of a system that has at its heart the relentless desire to turn a profit.

Even worse, a much-ballyhooed part of the promised ?21st Century transformation? into greater ?affordability? has turned out be little more than a profiteering scheme.

Remember the ?streamlining? and ?cost savings? guaranteed from the conversion to electronic medical records? Well, it hasn?t quite panned out. In fact, the only real beneficiaries of the conversion are companies like General Electric that sell electronic medical records systems. Not coincidentally, GE and other interested parties funded the key RAND study in 2005 that both predicted $81 billion in savings for America?s health care system and also became the driving rationale for the profitable conversion.

This type of closed system is par for the course in Washington, D.C.

Every door revolves in the nation?s only recession-proof city. Is it any surprise that the woman who wrote the Affordable Care Act is now leaving the White House for a job with health care giant Johnson & Johnson? Liz Fowler worked for Senator Max Baucus (D-MT) during the drafting of the ACA and had the primary responsibility for authoring the legislation. After its passage, she migrated to the White House to help with implementation. Seems reasonable enough. However, it is important to note where she was before joining the staff of Senator Baucus. Yup, you guessed it?she was a bigwig at WellPoint, the nation?s second leading health insurance company with nearly 54 million policyholders.

All of this makes you wonder who knew whom in the breast milk-pump industry, which is seeing a huge spike in its profits thanks to a new coverage requirement written into the ACA.

It may be too early to render judgment on a law that hasn?t yet been fully implemented, but it is not too early to determine that the profit motive might simply be incompatible with the equitable delivery of healthcare. As matter of course, businesses try to lower costs and increase revenue. That may be okay when they sell scissors or candlesticks, but it seems ill-suited to deliver labor-intensive care for those who are most vulnerable.

And as far as the health of the insurance industry, it?s a safe bet that they?ll keep coming out on top as the Affordable Care Act is fully implemented.
