Edward Snowden, the 29-year-old NSA contractor behind the PRISM leak, broke his long silence last week because he wanted Americans to know just how completely their privacy has been eviscerated in the name of security. "My sole motive is to inform the public as to that which is done in their name and that which is done against them," he told the Guardian in an interview. "I will be satisfied if the federation of secret law, unequal pardon, and irresistible executive powers that rule the world that I love are revealed even for an instant."

But by detailing the mammoth electronic surveillance program that, as he told the Washington Post, "quite literally" allows the NSA to "watch your ideas form as you type," Snowden also hoped to make possible a legal challenge to the surveillance state -- one that had previously been hampered by the thorny question of standing. In that, however, Snowden may ultimately come up short.

On Feb. 26, the Supreme Court ruled in Clapper v. Amnesty International USA that Americans lacked standing to challenge an amendment to the Foreign Intelligence Surveillance Act that authorized electronic surveillance of non-U.S. citizens abroad -- but which inevitably resulted in the surveillance of persons inside the United States -- because, in essence, the snooping was classified and therefore couldn't be proven to exist. As Justice Samuel Alito wrote in the majority opinion, "respondents fail to offer any evidence that their communications have been monitored" under the expanded version of FISA. Theirs, according to Alito, was a "highly speculative fear."

The decision split the court 5 to 4, with Justice Stephen Breyer, joined by the remainder of the court's liberal wing, dissenting. In Breyer's view, the standard adopted by the majority -- that the harm to respondents (being snooped on) must be "certainly impending" -- "is not, and never has been, the touchstone of standing." And even if it was, he writes, "this harm is not 'speculative.' Indeed it is as likely to take place as are most future events that commonsense inference and ordinary knowledge of human nature tell us will happen." ?

Snowden's revelations would seem to remove all doubt that Americans have been swept up in the NSA's colossal dragnet. Even if we accept the vigorous protestations of both the Obama administration and the tech companies allegedly participating in PRISM, the surveillance program has at least been partially declassified and acknowledged to impact at least some unsuspecting citizens.

According to the fact sheet released by Director of National Intelligence James Clapper, the relevant provisions of FISA contain "minimization procedures" that "govern how the Intelligence Community (IC) treats the information concerning any U.S. persons whose communications might be incidentally intercepted and regulate the handling of any nonpublic information concerning U.S. persons that is acquired, including whether information concerning a U.S. person can be disseminated."

"Significantly," the fact sheet continues, "the dissemination of information about U.S. persons is expressly prohibited unless it is necessary to understand foreign intelligence or assess its importance, is evidence of a crime, or indicates a threat of death or serious bodily harm." In other words, the government can, without an individual warrant, disseminate intelligence "incidentally" intercepted about American citizens living within U.S. borders so long as that intelligence implicates them in a crime, informs foreign intelligence, or represents a serious threat.

Yet despite such revelations, future plaintiffs seeking to challenge the NSA's surveillance program on First or Fourth Amendment grounds will still likely run up against the problem of standing, according to legal experts. As Lyle Denniston, a legal journalist and constitutional advisor to the National Constitution Center in Philadelphia, told FP in an email: "The near-universality of the surveillance here does not count as evidence of who was monitored, in a factual sense.?These new revelations are not sufficiently different from the program at issue in the Clapper decision, so that decision very likely dooms any challenge."

"The Clapper decision rules out any reliance upon probability of being overheard, so it is difficult, given the secrecy of the program, to imagine that anyone can show they actually were monitored," writes Denniston. ?

Stephen Vladeck, a law professor and the dean for scholarship at American University, had a similar take: "I don't think that the PRISM leaks will directly bear on the standing issue identified by the Supreme Court in Clapper, because even with what is now publicly known about the program, individual plaintiffs will still have the same problem -- proving that their communications, in particular, have been, or will be, intercepted," he wrote in an email. ?

Still, Vladeck cautions, judges "don't live in a vacuum." Even if individual plaintiffs will still face an uphill battle, "courts going forward may not be nearly as skeptical of the possibility that this kind of systematic interception of communications is really going on." At the same time, he writes, the revelations "certainly makes it that much harder ... to buy into Justice Alito's rather rose-colored vision of the scope of governmental surveillance."

While Snowden's big leaks may not turn the legal tables on the NSA, we can be virtually certain that they will be at the center of future lawsuits seeking to rein in the surveillance state. Already, Larry Klayman, a former Justice Department prosecutor and the founder of Judicial Watch, has expanded his lawsuit against the Obama administration to cover the NSA's monitoring of Verizon call logs, disclosed by the Guardian last week. It's only a matter of time before PRISM is at the heart of a similar suit. ??

2-D electronics take a step forward: Semiconducting films for atom-thick circuits

June 10, 2013 ? Scientists at Rice University and Oak Ridge National Laboratory (ORNL) have advanced on the goal of two-dimensional electronics with a method to control the growth of uniform atomic layers of molybdenum disulfide (MDS).

MDS, a semiconductor, is one of a trilogy of materials needed to make functioning 2-D electronic components. They may someday be the basis for the manufacture of devices so small they would be invisible to the naked eye.

The work appears online this week in Nature Materials.

The Rice labs of lead investigator Jun Lou, Pulickel Ajayan and Boris Yakobson, all professors in the university's Mechanical Engineering and Materials Science Department, collaborated with Wigner Fellow Wu Zhou and staff scientist Juan-Carlos Idrobo at ORNL in an unusual initiative that incorporated experimental and theoretical work.

The goals were to see if large, high-quality, atomically thin MDS sheets could be grown in a chemical vapor deposition (CVD) furnace and to analyze their characteristics. The hope is that MDS could be joined with graphene, which has no band gap, and hexagonal boron nitride (hBN), an insulator, to form field-effect transistors, integrated logic circuits, photodetectors and flexible optoelectronics.

"For truly atomic circuitry, this is important," Lou said. "If we get this material to work, then we will have a set of materials to play with for complete, complicated devices."

Last year, Lou and Ajayan revealed their success at making intricate patterns of intertwining graphene and hBN, among them the image of Rice's owl mascot. But there was still a piece missing for the materials to be full partners in advanced electronic applications. By then, the researchers were already well into their study of MDS as a semiconducting solution.

"Two-dimensional materials have taken off," Ajayan said. "The study of graphene prompted research into a lot of 2-D materials; molybdenum disulfide is just one of them. Essentially, we are trying to span the whole range of band gaps between graphene, which is a semimetal, and the boron nitride insulator."

MDS is distinct from graphene and hBN because it isn't exactly flat. Graphene and hBN are flat, with arrays of hexagons formed by their constituent atoms. But while MDS looks hexagonal when viewed from above, it is actually a stack, with a layer of molybdenum atoms between two layers of sulfur atoms.

Co-author Zheng Liu, a joint research scientist in Lou's and Ajayan's labs, noted the Yakobson group predicted that MDS and carbon atoms would bind. "We're working on it," he said. "We would like to stick graphene and MDS together (with hBN) into what would be a novel, 2-D semiconductor component."

"The question now is how to bring all the 2-D materials together," said co-author Sina Najmaei, a Rice graduate student. "They're very different species and they're being grown in very different environments."

Until recently, growing MDS in a usable form has been difficult. The "Scotch tape" method of pulling layers from a bulk sample has been tried, but the resulting materials were inconsistent, Lou said. Early CVD experiments produced MDS with grains that were too tiny to be of use for their electrical properties.

But in the process, the researchers noticed "islands" of MDS tended to form in the furnace where defects or even pieces of dust appeared on the substrate. "The material is difficult to nucleate, unlike hBN or graphene," Najmaei said. "We started learning that we could control that nucleation by adding artificial edges to the substrate, and now it's growing a lot better between these structures."

"Now we can grow grain sizes as large as 100 microns," Lou said. That's still only about the width of a human hair, but in the nanoscale realm, it's big enough to work with, he said.

Once the Ajayan and Lou teams were able to grow such large MDS arrays, the ORNL team imaged the atomic structures using aberration-corrected scanning transmission electron microscopy. The atomic array can clearly be seen in the images and, more importantly, so can the defects that alter the material's electronic properties.

"In order to improve the properties of 2-D materials, it's important to first understand how they're put together at a fundamental scale," Idrobo said. "Our microscopy facility at ORNL allows us to see materials in a way they've never been seen before -- down to the level of individual atoms."

Yakobson, a theoretical physicist, and his team specialize in analyzing the interplay of energy at the atomic scale. With ORNL's images in hand, they were not only able to calculate the energies of a much more complex set of defects than are found in graphene or BN but could also match their numbers to the images.

Among the Yakobson team's interesting finds was the existence, reported last year, of conductive subnano "wires" along grain boundaries in MDS. According to their calculations, the effect only occurred when grains met at precise 60-degree angles. The ORNL electron microscopy images make it possible to view these grain boundaries directly.

The Rice researchers see many possible ways to combine the materials, not only in two-dimensional layers but also as three-dimensional stacks. "Natural crystals are made of structures bound by the van der Waals force, but they're all of the same composition," Lou said. "Now we have the opportunity to build 3-D crystals with different compositions."

"These are very different materials, with different electronic properties and band gaps. Putting one on top of the other would give us a new type of material that we call van der Waals solids," Ajayan said. "We could put them together in whatever stacking order we need, which would be an interesting new approach in materials science.

Co-authors of the Nature Materials paper are Rice research associate Xiaolong Zou, graduate students Gang Shi and Sidong Lei, and Wu Zhou at Oak Ridge National Laboratory.

The Welch Foundation, the National Science Foundation (NSF), the U.S. Army Research Office, the U.S. Office of Naval Research, the Nanoelectronics Research Corporation and the Department of Energy supported the work.

Lou is an associate professor of mechanical engineering and materials science. Ajayan is the Benjamin M. and Mary Greenwood Anderson Professor in Engineering and a professor of mechanical engineering and materials science, chemistry and chemical and biomolecular engineering. Yakobson is the Karl F. Hasselmann Professor of Mechanical Engineering and Materials Science and a professor of chemistry.

Computations were performed on Rice's DAVinCI system and at the Cyberinfrastructure for Computational Research, both funded by NSF.

Amid fears about debt, one family goes to the extreme to avoid student loans

Olivia and Claudia Poglianich (Photo courtesy Olivia Poglianich)Claudia Poglianich had just one major request when her daughter Olivia began looking at colleges two years ago: that Olivia would pick a school where she had the greatest chance of emerging debt-free.

It was an ask that seemed almost quaint in a world where college costs have reached record highs and students are almost expected to incur major debts to pay for their education. But Claudia, a 45-year-old public relations worker for government agency in Oyster Bay, N.Y., was determined to have her daughter escape the albatross of student loan debt that weighs down many college graduates.

?It?s horrible what these young people are going through, leaving school with all this debt that they struggle to pay back,? Claudia told Yahoo News. ?I didn?t want that for my daughter.?

So when she graduates in two years, Olivia, a 20-year old communications major at Cornell University, is aiming to be a rare case in higher education: a graduate from modest means with zero student loan debt.

It?s a goal Olivia admits is a struggle sometimes?especially at a university where she says so many of her classmates are financially better off than she is or are relying on major loans that allow them to spend more money.

?It is not always easy, but it is amazing that I will graduate from here without a lot of debt,? Olivia said. ?I will be incredibly lucky."

The road to being free from student debt hasn't been without sacrifices for Olivia or Claudia.

It began with Olivia bypassing other schools that had been on her wish list, including Boston College, Northwestern, and the University of Southern California?none of which offered enough financial aid to make it possible for her to attend. She also considered some state schools, but none seemed to have the? endowment program available to help students in need.

"We had to look at schools like they were a business," Claudia said. "Who could offer us the best package in the long run?"

Cornell's tuition and fees total an eye-popping $61,000 per year. But because of Olivia's high grade point average and Cornell's $5 billion endowment?one of the largest of any university in the United States?she's eligible for a number of scholarships and other types of financial aid.

Claudia pays whatever is left over, with help from Olivia?who, in addition to holding down a full-time schedule of classes, works as an administrative assistant at Cornell?s career services office while at school and works summer jobs at home. She also participates in unpaid internships. "Time management," Olivia says, "is not a problem for me."

But Claudia has made the bigger sacrifice.

As a single mom, she has scrimped and saved for years to pay for Olivia?s college education. Years ago, Claudia stopped contributing to her own 401(k) and other retirement accounts, putting the money into Olivia?s college fund instead.

Claudia also sold her house and lives with a roommate. And instead of leasing a car, she borrows a friend?s to save money. Though she declines to specify numbers, Claudia says most of her salary goes toward Olivia?s tuition.

The most nerve-wracking month of the year for the Poglianich family is May, when Cornell discloses how much financial assistance it will give a student for the upcoming year. The number is never the same, Claudia said, adding that she still hasn?t heard how much she?ll have to pay for Olivia's tuition next year.

?Every year, we hold our breath. My contribution of my salary has been going up, and you tighten the belt buckle more,? Claudia said. ?I tease Olivia, and say, ?You know, Mommy doesn?t have a shoe fetish like most women my age. I have a tuition fetish.??

It?s unclear how many families are like the Poglianiches?there are no statistics on how many students try to get through college without incurring student loan debts. But Claudia?s push is not entirely surprising amid growing concerns that student loans might be hurting the nation?s economic recovery.

According to the Consumer Financial Protection Bureau, student loan debt surpassed $1 trillion last year, and it's only expected to increase given the growing number of people who returned to college amid a weakened job market over the last two years.

The uptick in student debt has been linked to negative effects on the larger economy, in part because debt-ridden students have been forced to postpone or skip normal rites of life, like buying homes.

But student loans may be a sound investment in the long run. Education Secretary Arne Duncan and others have repeatedly described such loans as ?good debt??in that paying for a college education ultimately helps people secure a better job and make more money.

A study released last August by the Georgetown University Center on Education and the Workforce found that of the jobs recovered from the recent recession, ?virtually all ? required some sort of postsecondary education.? The same study found that college graduates were hired for better jobs that paid more money.

?You are still better off getting a college education and having that debt,? said Chris G. Christopher, an economist at IHS Global Insight who has studied the effects of the growing student loan debt on the economy.

Christopher said the job market is far tougher on someone ?who doesn?t go to college and doesn?t get any student debt.? Even the low-end blue-collar jobs have grown more limited in the tough economy, he said.

?So, in a sense, it?s good to have that debt and get the education so that you have more possibilities,? Christopher said?though he added that success also depends on what kind of degree and employment an individual is pursuing.

With her financial aid for next year still up in the air, Olivia is quick to note that taking out a loan ?wouldn?t be the worst thing in the world??something her mom agrees with, though she insists it should be a last-ditch measure.

Years after she got her own degree, Claudia still remembers how much her monthly checks were to Sallie Mae?which she was still paying off when Olivia was born.

?Two hundred and twenty-three dollars and 83 cents,? Claudia recalled, with a laugh. ?I remember that total so well. It has stuck with me.?

While she long ago paid off her own loans and doesn?t know anyone her age still working to pay off their student debt, Claudia isn?t so sure that will be the case for Olivia?s generation, which is incurring bigger debts because of the spike in college costs. That's why she is so determined to help her daughter, even if that means she has to make major sacrifices in her own life.

?Something is wrong here,? Claudia said. "All my choices, all of her choices, are governed by how expensive college is, and I know we can't be alone. ... Something has to be done, but I don't know what. I hate the burden that gets put on these kids."

She added, "We're scraping by, and it's tough. But when she gets that diploma in two more years, it will all be worth it.?

NASA has doled out a research grant to develop a prototype 3D printer for food, so astronauts may one day enjoy 3D-printed pizza on Mars.

Anjan Contractor, a senior mechanical engineer at Systems and Materials Research Corporation (SMRC), based in Austin, Texas, received a $125,000 grant from the space agency to build a prototype of his food synthesizer, as was?first reported by Quartz.

NASA hopes the technology may one day be used to feed astronauts on longer space missions, such as the roughly 520 days required for a manned flight to Mars. Manned missions to destinations deeper in the solar system would require food that can last an even longer amount of time.

"Long distance space travel requires 15-plus years of shelf life," Contractor told Quartz. "The way we are working on it is, all the carbs, proteins, and macro and micro nutrients are in powder form. We take moisture out, and in that form it will last maybe 30 years."

Dividing the various components of food in powder cartridges would theoretically enable users to mix them together, like the ingredients in normal recipes, to create a diverse array of nutritious meals.

To prove his idea works, Contractor printed chocolate. Now, he's aiming to build a more advanced prototype to print a pizza, according to Quartz.

The system will start by "printing" a sheet of dough, followed by a layer of tomato "sauce," which will consist of the powder mixed with water and oil. Instead of traditional toppings, the?3D-printed?pizza will be finished off with a layer of protein, which can be derived from animals, milk or plants, Contractor told Quartz.

While NASA sees applications for?3D printers?on future manned space missions, Contractor said his food synthesizer could also be an effective way of addressing the problem of food shortages from rapid population growth.

"I think, and many economists think, that current food systems can't supply 12 billion people sufficiently," Contractor told Quartz. "So we eventually have to change our perception of what we see as food."
